The FBI conducted weekend raids in three states and arrested eight people tied to a Michigan-based militia group that authorities say was conspiring to kill police officers.

WASHINGTON -- Nine suspects tied to a militia in the Midwest are charged with conspiring to kill police officers, then attack a funeral in the hopes of killing more law enforcement people, federal prosecutors said Monday.

U.S. Attorney Barbara McQuade said agents moved on the group because the Hutaree members were planning a violent reconnaissance mission sometime in April -- just a few days away.

Members of the group called Hutaree are charged in the case, including their leader, David Brian Stone, also known as "Captain Hutaree."

Once other officers gathered for a slain officer's funeral, the group planned to detonate homemade bombs at the funeral, killing more, according to newly unsealed court papers.

The indictment includes charges of seditious conspiracy, possessing a firearm during a crime of violence, teaching the use of explosives, and attempting to use a weapon of mass destruction -- homemade bombs.

The indictment charges members of the group conspired "to levy war against the United States, (and) to oppose by force the authority of the government of the United States."

The charges follow FBI raids over the weekend on locations in Michigan, Ohio, and Indiana.

According to investigators, the purportedly Christian Hutaree militia view local, state, and federal law enforcement personnel as a "brotherhood" and an enemy, and planned to attack them as part of an armed struggle against the U.S. government.

Eight suspects have been arrested by the FBI, and one more is being sought. Of the eight captured, seven are due in court later Monday.

Andrew Arena, head of the FBI's field office in Detroit, said the case "is an example of radical and extremist fringe groups which can be found throughout our society. The FBI takes such extremist groups seriously, especially those who would target innocent citizens and the law enforcement officers who protect the citizens of the United States."

Sex Offender Suspected in California Teen's Murder Broke Parole

SACRAMENTO, Calif. — A convicted sex offender charged with murdering one California teenager and under investigation for another killing violated his parole by moving too close to a school but was allowed to remain free, according to records obtained Thursday by The Associated Press.

Had John Albert Gardner III been returned to prison in 2007 he would have been evaluated for commitment to a state mental hospital as a sexually violent predator. He also would have qualified for wearing an electronic tracking device for the rest of his life.

"It was just an incompetent decision that didn't protect public safety," said state Sen. George Runner, who wrote Jessica's Law, the sex offender law approved by voters in 2006.

"And now we have, what, two victims and who knows what else is out there?" he said.

The parole records show state officials found Gardner illegally living within a half-mile of a school in September 2007 and decided to keep him on parole. The records show at least five later violations, the last on Sept. 8, 2008, just 18 days before Gardner was let go from parole supervision and his location-tracking GPS bracelet removed from his ankle.

Each time, the decision was "COP:" Continue on Parole.

"All the indications were there saying that this was a very serious situation," said Nancy Kincaid, spokeswoman for the state Department of Mental Health. "A very serious evaluation would have been followed all the way through."

Gardner's attorney, Michael John Popkins, did not return a telephone message. He is under a court-ordered gag order not to talk about the case.

Gardner, 30, served five years in prison and three years of parole after pleading guilty in 2000 to molesting a 13-year-old neighbor girl.

He pleaded not guilty last week to murdering Chelsea King, 17, whose presumed body was found March 2 buried in a park near her hometown of Poway north of San Diego.

He also is charged with assaulting a woman in the same park in December, and is a suspect but has not been charged in the disappearance of 14-year-old Amber Dubois as she walked to school in Escondido in early 2009.

Her skeletal remains were found Saturday on an Indian reservation.

"There was nothing to indicate then that he would do this, or allegedly do this," said Oscar Hidalgo, spokesman for the California Department of Corrections and Rehabilitation. "I guess one can always look back, but we don't have the luxury."

In fact, Gardner was considered to be a low- or moderate-risk sex offender, based on the assessment in use at the time, Hidalgo said.

He wasn't sent back to prison in September 2007 because he corrected the residency violation by moving away from a college campus that had a day care center, Hidalgo said.

He had six other technical violations — one more than shown in the records obtained by the AP, Hidalgo said.

Four involved letting the battery on his ankle bracelet run low, one for missing a meeting with his parole officer, and one for alleged marijuana possession that couldn't be substantiated.

"These are considered minor. Quite frankly if we were to blanket the system of parolees with minor offenses, we would ... overwhelm the system. We'd close the system down," Hidalgo said.

Laura Ahearn, executive director of New York-based Parents for Megan's Law and The Crime Victims Center, said parole agents missed a chance to possibly put Gardner away for years.

"A technical violation is an opportunity to take sexual predators off the street. Most would be looking for that opportunity," she said. "He could have been confined, and this may never have happened."

If officials ruled that Gardner violated his parole, they could have sent him back to prison, though most serve only about four extra months behind bars. However, the new prison term would have extended his parole supervision.

The violation also would have put Gardner under the jurisdiction of Jessica's Law and permitted lifetime electronic monitoring. In addition, it would have permitted Gardner's evaluation as a sexually violent predator, potentially keeping him locked up in a state mental health hospital for years.

Gardner couldn't be committed to a state mental hospital after the 2000 case because the law then required at least two victims. Jessica's Law now allows evaluations after just one.

Kincaid, the mental health spokeswoman, said Gardner might have been committed for having an underlying mental disorder and a likelihood that he would reoffend. However, the law involving commitment generally requires that the victim be a stranger. In this case, his victim was a neighbor who had known and trusted him for a year.

Gardner's 2000 probation report included comments from a psychiatrist who concluded he had "significant predatory traits" and should be kept in prison for as long as possible.

Kincaid said it was unclear from the records if the traits would qualify him as a sexually violent predator under the law.

The AP independently obtained computer-generated portions of Gardner's parole record after the corrections department reported it had routinely destroyed its paper field notes a year after Gardner was released from parole.

The department disclosed Tuesday that portions of the file were transferred to Gardner's central file.

Police are searching for Maurice Clemmons, “Person of Interest” after four Washington Police Officers, shot and killed in a Parkland coffee-shop as they were preparing for their shift, were ambushed and murdered. The four officers, Sergeant Mark Renninger, Ronald Owens, Tina Griswold, and Greg Richards all died at the scene.

The officers were all original members of the Lakewood Police Department. Between the four officers nine children were left behind. Read more about this tragic story, see pictures of the fallen officers, and see a video news report below.

Authorities are reporting that the killer may have been wounded by one of the slain officers who was able to fire shots at the suspect before he died. Police Spokesman Ed Troyer stated the following:

“There is evidence that a Lakewood Police officer fired off some shots, and we hope that he hit him,” said Troyer. “If he’s hit, that means that he’s injured somewhere with a gunshot wound.”
Troyer said local hospitals have been contacted in case the suspect seeks medical attention.

Maurice Clemmons has been identified as a “Person of Interest” in the slayings. Clemmons has a lengthy criminal history in Arkansas and was in jail in Washington until approximately six days ago. It is also being reported that Clemmons was sentenced to 95 years behind bars in Arkansas but then governor Mike Huckabee commuted the sentence after nine years.

The Lakewood Police Chief, Chief Bret Farrar, issued the following statement:

“This is a very difficult time for our families and our officers. The families will have many challenges ahead of them and we ask that their privacy be respected. Please keep our families and Lakewood Police in your prayers,”

The suspect walked into the coffee shop and acted as if he were going to order coffee when he then turned and opened fire. Two of the officers were immediately killed while sitting at their table, one officer was killed as they stood up to respond to the attacker and the fourth officer was killed after fighting with the suspect. None of the other patrons at the location were injured, and no one was robbed. It appears that the only motive the suspect had was to kill police officers. The suspect is described as a black male between 25 and 35, rough face and hair, wearing a black coat, jeans

Documents Say Clemmons Had Bizarre Visions, Threatened Jail Workers

SEATTLE -- The man police said gunned down four Lakewood police officers Sunday had been exhibiting bizarre behavior during an arrest in May, police documents said.

Clemmons was charged earlier this year with assaulting a police officer and raping a child, and investigators in the sex case said he was motivated by visions that he was Jesus Christ and that the world was on the verge of the apocalypse.

Documents related to those charges indicated that Clemmons had a volatile personality. In one instance, he is accused of gathering his wife and young relatives and forcing them to undress. Following May's charges, Clemmons was ordered to receive a mental health evaluation On Oct. 19. KIRO 7's partner, the News Tribune, obtained a copy of that report, which said Clemmons threatened to kill jail workers, saying, "I'll kill all you bitches," and described hallucinations in which he saw people drinking blood and eating babies.

The report said at the time of his arrest, Clemmons made "religiously-themed comments, told the officer President Obama and Lebron James are his brothers, Oprah is his sister and referred to himself as 'the beast.'"

Two psychologists concluded Clemmons was dangerous, and likely to commit future criminal acts jeopardizing public safety, but he was deemed competent to stand trial and not a candidate for voluntary commitment.

Clemmons was released after posting a combined bail of $190,000 for the two charges.

Police said they aren't sure what prompted Clemmons to shoot the four officers, who were in uniform and working on paperwork at the coffee shop just two blocks outside their jurisdiction on Sunday.

"The only motive that we have is he decided he was going to go kill police officers," Pierce County sheriff's spokesman Ed Troyer said. He said Clemmons talked the night before the shooting about killing a group of cops and watching the news.

Clemmons was shot dead by a Seattle police officer who found Clemmons outside a stolen car on a Rainer Valley street early Tuesday.

10 Bodies Found Convicted Ohio Sexual Predator Charged With Murder; More Bodies Found??

Ohio police charged a convicted sexual predator with 5 counts of aggravated murder hours after four more bodies were taken from the man's backyard and a skull was removed from his basement.

Anthony Sowell, 50, also was charged Tuesday with rape, felonious assault and kidnapping, Cleveland police spokesman Lt. Thomas Stacho said.

The gruesome new discovery comes after 6 bodies were found last week in the Sowell's house, bringing the total number discovered there to 10. Authorities do not know whether the skull belongs to an eleventh victim.

Sowell will be arraigned Wednesday.

Cadaver dogs unsuccessfully searched Sowell's backyard throughout the day, but found the remains while using a backhoe to dig up portions of the yard, Cleveland Police Chief Michael McGrath said Tuesday night.

"It appears that this man had an insatiable appetite that he had to fill," McGrath said.

He couldn't say specifically where in the backyard the bodies were discovered or if any of them were decapitated, but said the skull was found wrapped in a paper bag in a bucket in Sowell's basement.

The police chief said he hopes the coroner’s office will be able to identify the gender of the victims by Wednesday morning.

Police will be working throughout the night, McGrath said, adding that they will be searching walls and ceilings of the house on Wednesday.

"We will do everything to confirm there is nothing else there," he said.

The county's sheriff's office routinely checked on Sowell because he was a registered sexual predator. The most recent visit was Sept. 22, according to McGrath.

Sowell is reportedly not fully cooperating with police and has asked for a lawyer.

Sowell did, however, give authorities information that led them back to his house, a high-ranking authority on the scene told Fox 8 in Cleveland.

Police officers came under attack while they tried to help a dying man at the G20 protests in London's financial district Wednesday night.

The victim was found by a member of the public unconscious in the street near the Bank of England just before 7:30 p.m.

A spokesman for the Metropolitan Police said officers arrived on the scene to help and had to move the casualty away for urgent treatment after bottles were thrown at them by protesters.

The man was eventually pronounced dead at the hospital. According to one protester at the scene he was in his 30s. Ninety people were arrested during a first day of protests marking the summit.

The Met Police spokesman said: “A member of the public went to a police officer on a cordon in Birchin Lane, junction with Cornhill to say that there was a man who had collapsed round the corner.

(CNN) -- A suspect has been arrested in the 1990 abduction and attempted murder of an 8-year-old Texas girl, a spokeswoman for the FBI's Houston, Texas, office said.
The victim, Jennifer Schuett, is now 27. She recently shared her story with CNN in hopes of someday bringing her attacker to justice.

Schuett fought tears as she spoke at a news conference in Dickinson, Texas. "This event in my life 19 years ago was a tragic
one," she said. "I want you to know I am OK. I am not a victim but instead victorious."

She continued, "I hope that my case will remain as a reminder to all victims of violent crime to never give up hope ... With determination and by using your voice to speak out, you are capable of anything."

Dennis Earl Bradford, a welder, was arrested 6:50 a.m. Tuesday in Little Rock, Arkansas, authorities said. He was on his way to work, and his wife was in the car with him.

DNA and other forensic testing led to him, authorities said. His DNA profile was in the FBI database due to a conviction in Arkansas.

Dunlap thanked CNN for publicizing the story and said investigators "received lots of tips and good reaction." But advances in forensic testing led directly to the arrest, she said.

Schuett was abducted from her bedroom, raped and left for dead August 10,1990. She spoke with CNN two weeks ago.

CNN normally does not identify victims of sexual assaults. But Schuett decided to go public with her story -- and her name -- to increase the chances of finding and prosecuting her attacker.

"It's not about me anymore," she told CNN in September. "It's about all the little girls that go to sleep at night. I know there are so many girls out there who have been raped and hurt. You have to fight back."

"I remember everything; I've always wanted to remember everything so I can find the person that did this," Schuett said. "If I had blocked this out of my memory, the investigation wouldn't have come this far. I'm a fighter."

Schuett says she was alone in her bed when a man crept in through a window. She remembers waking up in a stranger's arms as he carried her across a dark parking lot.

She said he told her he was an undercover cop and knew her family.

He drove her through the streets of Dickinson, Texas, pulling into a mechanic's shop next to her elementary school.

"Watch the moon. The moon will change colors, and that is when your mom will come to get you," she recalled him saying. "Oh, it looks like she is not coming."

Schuett said he drove her to an overgrown field next to the school and sexually assaulted her.

She passed out. When she regained consciousness, she was lying naked on top of an ant hill with her throat slashed from ear to ear, and her voice box torn.

She was found at 6 p.m. on a hot August day after lying in the field for nearly 12 hours. She was rushed to a hospital in critical condition.

"Three days after the attack, I started giving a description. The doctors told me I would never be able to talk again, but I proved them all wrong," Schuett said. She believes she got her voice back so she could tell her story.

Houston FBI Special Agent Richard Rennison is one of the lead investigators in the case, along with Dickinson police Detective Tim Cromie.

Both men were discussing the case when Rennison received a memo from the FBI's Child Abduction Rapid Deployment (CARD) team seeking child abduction cases that had gone cold and could be retested for DNA evidence. Schuett's was one of the cases selected.

Rennison, who has 10 years of experience in child abduction cases, said he has never seen a case like Schuett's.

"This is the only one that I can think of that the victim has suffered some traumatic injuries and survived," he said, "The main reason the CARD team picked this case was because she was alive. In cases of child abduction, it is rare that the child is recovered alive. Frequently, you recover a body. And most times, you never find them."

The investigators found evidence collected 19 years ago, which was retested. It included the underwear and pajamas Schuett was wearing, as well as a man's underwear and T-shirt, which were found in the field where Schuett was left for dead.

The clothes were tested in 1990, but the sample wasn't large enough for conclusive results. But now, modern techniques allow DNA to be isolated from a single human cell.
They were still awaiting the results when CNN featured Schuett's story in late September.

Kevin Jennings, President Obama's Assistant Deputy Secretary of the Office of Safe and Drug FreeSchools at the U.S. Department of Education, is in hot water this week for having failed to report that a 15-year-old sophomore student in his school had told him of having sex with an older man.

But failure to report what appeared to be a case of statuatory rape of a child may be the least of Jennings' worries. Lori Roman of Regular Folks United points to statements by Jennings a decade or more ago when he praised Harry Hay of the North American Association for Man-Boy Love Association (NAMBLA), which promotes the legalization of sexual abuse of young boys by older men.

Roman provides damning details and links here. She also notes that Jennings wrote the forward "to a book called Queering Elementary Education. And another fellow you may have heard of wrote one of the endorsements on the book jacket—Bill Ayers." Ayers, of course, is the Weather Underground bomber from the 1960s who is just an "acquaintance" of Obama.

Every presidential administration ends up with scandals inspired by controversial appointees, but typically those tend to revolve around financial improprieties, conflicts of interest, or some other form of white-collar misconduct. For Obama, the scandals seem to be develping in a pattern of disclosures revolving around radical left ideology that raises questions about their fitness for any job in government. And that in turn raises the inevitable question: Is nobody minding the White House personnel store?

Hay was not an employee or official of NAMBLA, but was during his later years, according to his entry on Wikipedia, a frequent defender of the group, including this 1983 statement: "[I]f the parents and friends of gays are truly friends of gays, they would know from their gay kids that the relationship with an older man is precisely what thirteen-, fourteen-, and fifteen-year-old kids need more than anything else in the world."
MM has a point - Jennings praise of Hay was not specifically in the context of the latter's support of NAMBLA. Medical Examiner: Body Found Is Missing Yale Graduate Student

A body found stuffed in the wall of a Yale university building has been indentified as missing graduate student Annie Le, New Haven police said Monday.

Authorities, who have ruled Le's death a homicide, said they do not believe the 24-year-old bride-to-be was a random target.

Le was last seen on surveillance video Tuesday entering the five-story laboratory building in Yale's medical complex, where she worked as a graduate pharmacology student.

Police told the Associated Press Monday that the killing of the person whose body was found in the wall was "not a random act" — and said they don't believe that anyone else on the campus is in danger.

Authorities on Saturday also found bloody clothes above floor tiles in the basement of the building, which police sources say likely belonged to the killer.

Yale President Richard Levin offered support to Le's family and her fiance, Columbia University graduate student Jonathan Widawsky. The couple was to marry Sunday in Syosset, N.Y., on Long Island's north shore.

"The family and fiance and friends now must suffer the additional ordeal of waiting for the body to be positively identified," Levin said.

The university has also planned an evening prayer vigil for Le at 8 p.m. Monday on Yale's main campus. An e-mail sent to the Yale community invites participants to "bring a candle and join us in solidarity," the Yale Daily News reported.

In an e-mail statement sent to FOXNews.com, Yale's vice president Linda Lorimar said the university was taking extra security precautions — including added security personnel and a new bicycle patrol — to ensure students' safety.

Police on Monday would not say if they have any suspects. They previously have said Widawsky is not a suspect and is assisting with the investigation. New Haven Assistant Police Chief Peter Reichard said police recovered "a large amount" of physical evidence, but he would not discuss what that included.

Last winter, Le, of Placerville, Calif., wrote a magazine article about how to stay safe around Yale's campus. The article, titled "Crime and Safety in New Haven," was published in February in a magazine produced by the university's medical school. It compares higher instances of robbery in New Haven with cities that house other Ivy League schools and includes an interview with Yale Police Chief James Perrotti, who offers advice such as "pay attention to where you are" and "avoid portraying yourself as a potential victim."

"In short, New Haven is a city and all cities have their perils," Le concludes. "But with a little street smarts, one can avoid becoming yet another statistic."

Le was reported missing last Tuesday. Surveillance video shows her arriving at around 10 a.m., but police could find no video of Le leaving, despite some 75 surveillance cameras operating around the complex. Her ID, money, credit cards and purse were found in her third-floor office.

More than 100 local, state and federal police had been searching the building for days, using blueprints to uncover any place where evidence or Le's body could be hidden.

On Sunday morning, a state police van drove down a ramp into the building's basement area. Authorities also sifted through garbage at a Hartford incinerator Sunday, looking through trash that was taken from the building in the days since Le went missing.

Le's disappearance weighed heavily on Yale students, who prayed for her safe return Sunday at The University Church on Yale's campus.

"It has brought up a lot of fears for people," the Rev. Ian Buckner Oliver said just before he gave the Sunday morning sermon. "It has brought up a lot of worry and concern for her and for all our safety."

Bjorn Cooley, a 20-year-old Yale student from Oregon, said he heard the news that a body had been found while studying in his room Sunday night.

"Before they found the body, I still had hope she had just disappeared," Cooley said. "I was looking for some sort of quasi-happy ending to this whole thing."

Have you been following the missing Yale student story? She was to get married this weekend....she is on video entering a Yale building but she is not seen on video leaving. Any ideas?

Yale University announced a $10,000 reward for help finding a graduate student days before her wedding, after investigators find no clues after searching her laboratory and apartment.

Annie Marie Le, 24, a doctoral student in pharmacology at Yale's School of Medicine, vanished Tuesday. She was last seen that morning on surveillance camera outside a lab in the medical school complex, less than mile from the main campus in New Haven, Conn.

The California native was to be married on Sunday to fiance Jonathan Widawsky, a graduate student in physics at Columbia University. The two met as undergraduates at the University of Rochester.

Her purse, cell phone, credit cards and money were found in her office. She has not contacted her fiance, family or friends since Tuesday.

“We are responding to this at this point as if it could be any kind of bad situation,” University Vice President and Secretary Linda Lorimer told the Yale Daily News. “You don’t just not go home for a couple of days.”

Widawsky has been cooperating with the investigation, she told the paper, and "there's not a worry about" any potential involvement he might have had in Le's disappearance.

Le was in her lab at the Sterling Hall of Medicine Tuesday morning, and then walked a few blocks to another lab facility at 10 Amistad Street. A security camera captured her going into the building at 10 a.m., the same time she swiped her Yale ID card at the entrance.

There was no image of her leaving, but Yale security officials were scanning all footage from surveillance cameras at each of the facility's entrances and exits.

Le was reported missing after she did not return to her office or show up for a pathology class where she was a teaching assistant, The New Haven Register reported.

Asked about the possibility of foul play, Yale spokesman Tom Conroy said Thursday that "there's no evidence of it at this time."

A fire alarm set off by a faulty smoke detector about 12:40 p.m. at the Amistad Street building isn't thought to be connected to Le's disappearance, university Deputy Secretary Martha Highsmith told the Yale Daily News.

On Thursday, Connecticut state police with bloodhounds searched the area where Le was last seen, and authorities went through nearby trash bins.

Yale Police Chief James Perrotti said the FBI was assisting in the investigation, and Le's fiance, professors, colleagues, friends and family also were helping in the search.

Ironically, Le wrote a magazine article earlier this year about how to stay safe on the Ivy League campus.

“Lucky I’m in love with my best friend,” Le wrote in a posting on Facebook, one of several about the marriage, according to the Register. Others included details about the ceremony, the reception and the honeymoon in Greece.

She received her undergraduate degree in bioscience in 2007 from the University of Rochester in New York state, said school spokeswoman Sharon Dickman.

While at the University of Rochester, she did a summer project at the National Institutes of Health on bone tissue engineering with a goal of regenerating tissue for people suffering from degenerative bone diseases. She said her career goal was to work as an NIH investigator or as a professor.

Her mentor, Rocky Tuan, described her as bright and hardworking, saying the NIH undergraduate scholars program was very selective.

"She's a very happy person," Tuan said. "Everybody got along with her. She's always smiling, laughing."

Le is 4-foot-11, 90 pounds and of Asian descent with brown hair and brown eyes.

The provision that President Obama refers to is Section 1233 of HR 3200, entitled “Advance Care Planning Consultation.” [2] With all due respect, it’s misleading for the President to describe this section as an entirely voluntary provision that simply increases the information offered to Medicare recipients. The issue is the context in which that information is provided and the coercive effect these consultations will have in that context.

Section 1233 authorizes advanced care planning consultations for senior citizens on Medicare every five years, and more often “if there is a significant change in the health condition of the individual … or upon admission to a skilled nursing facility, a long-term care facility… or a hospice program.” [3] During those consultations, practitioners must explain “the continuum of end-of-life services and supports available, including palliative care and hospice,” and the government benefits available to pay for such services. [4]

Here’s a story that should help you sleep at night, especially if you live in one of the southern border states. The Mexican government, plagued by corruption, replaced customs agents with the Army. Mexican customs agents fired to the tune of 1100 personnel. The Mexican Army is now in charge of customs at the US border.

In an anti-corruption sting of sorts, federal officials cleaned house at all US Mexican border stations. 1100 Mexican customs agents fired, and the Mexican Army taking over customs duties at all checkpoints.

In Nuevo Laredo, the agents were called in and told they were being let go; they were then asked to surrender their badges and weapons. As reported before, Mexico is in the middle of a major drug cartel war and a huge problem has been weapons and drugs being smuggled in and out of the country.

The Mexican army customs duties are only temporary, no word on how long the Army will be handling the customs role. One can only speculate how this may hurt or help the security of our country.

On the one hand, it appears good that the Mexican customs agents fired were apparently corrupt; on the other, how reliable is the Mexican government or the Mexican Army? How much corruption is there? Will it really stem the tide of weapons and drugs into or out of either country?

President Obama recently met with Felipe Calderon in Mexico pledging support for his military crackdown on drug cartels. Obama also pledged to help control our countries part in the ongoing drug war.

Over 1,000 Mexican customs agents fired seems like a step in the right direction; but is it? Was it an actual clamp down on corruption or more of a show for outsiders looking in? Only time will tell.

A Massachusetts mother was horrified when she found her 7-month-old child’s photo on popular promotions site, Craigslist, advertising his own adoption.

MyFOXBoston reports that a stranger alerted Jenni Brennan of Abington, Mass. to the photo, which involved her 7-month-old son, Jake, in an online adoption scam. The ad read: “A CUTE BABY BOY FOR ADOPTION HE IS VERY HEALTHY AND READY FOR ADOPTION FOR MORE YOU COME BACK TO US.”

Brennan responded to the ad, receiving an email describing her son as Canadian but currently living in an African orphanage.

She said the photo was from her family’s blog.

“I know he wasn’t being physically harmed and no one was going to come to our door and try to take him, but I felt like his likeness was being violated," she told MyFOXBoston.

She alerted the FBI and attorney general’s office to the scam. Yahoo! has also removed the scammer’s email addresses.

HOLLYWOOD, FL -- A cop's dashboard camera is supposed to catch criminals in the act.

For four Hollywood, Florida cops, the dash cam may have foiled their plans to frame a motorist.

The four police officers -- three of them longtime veterans of the force -- were caught on one of the cop's dash cameras plotting to place the blame for a February traffic accident on a woman one of them had hit with their patrol car.

The disturbing video shows the woman, Alexandra Torres Villa, handcuffed in the back of the squad car as the officers get their stories straight on what they are going to say happened.

Officer Joel Francisco, 36, an 11-year veteran, crashed into the back of Villa's vehicle at a light on February 17 at midnight. The cop radioed to other officers who converged on the scene and hatched a way to bail Francisco out.

Officer Dewey Pressley, 42, arrives and questions Villa, who tells him that she has been drinking. The 21-year veteran officer seizes the opportunity and arrests her for DUI. But the plot thickens from there.

The cops begin to brainstorm believable excuses for the accident.

"As far as I'm concerned. I'm going to put words in his mouth. She went to accelerate and a cat jumped out of the window at which point he thought it could have been a pedestrian, which distracted him," Pressley tells Sgt. Andrew Diaz, another veteran of the force. "I mean what's the chances of hitting a f---in drunk when a cat jumps out of the window?"

Still, the cops run with the half-baked idea and rush to get Villa to do a Breathalyzer test so they can officially say she was drunk.

"I nailed her on the video. I already hung her on video. She said she has been doing a beer party," Pressley says. "She's gonna blow."

Then, another cop debates with Pressley on who is going to write up the fabricated report to clear their police comrade.

"I know how I'm going to word this with the cat so we can get him off the hook. I'll write the narrative," Pressley says. "We're going to bend this a little bit."

Civilian Community Service Officer Karim Thomas joins the three senior officers and the four cops go so far as to change the angle of pictures of the accident to make it look like Villa swerved in front of the cop car and caused the accident, not Francisco.

Throughout the tape, the cops acknowledged what they are doing is illegal, but when you are the law, there is nothing wrong with bending it for a fellow cop, one says.

"I don't lie and make things up ever because it's wrong, but if I need to bend it a little bit to protect a cop, I'll do it," Pressley tells Francisco after reassuring him no one will ever find out. "She's freaking hammered anyway."

The cops even do a final rehearsal before Villa is taken to the city lock up.

"We'll take care of it," one officer says. The others reply: "We're good."

The police officers are currently on administrative leave pending a state attorney's office investigation.

Villa, who was charged with four counts of DUI and cited for improper lane change, is still fighting the charges in court.

Get Stoked Notes Broward County: this county coming back into the press reminded me of the controversial 2000 Bush election aftermath. Back then one of my favorite radio shows was from Col. Oliver North. Every afternoon when he signed on or off he always had 2 phone numbers for callers to take part in the talk. One was for normal callers and the other was for folks from Broward County who needed help marking their ballots. He would joke how his staff would spend extra time to help them because they needed it in Broward County.

Broward County demographic: Wicki From the 1992 U.S. presidential election onward, however, voters of Broward County backed the Democratic presidential nominee over the Republican nominee by strong majorities. Broward County is now the most reliably Democratic county in the state, ^[11]^[12] with the exception of the much less populous Gadsden County (where African Americans are a majority). This change in voting tendencies is most likely due to the continuous flow from large migrations of snowbirds and transplanted people from the liberal Northeast and other blue states, as well as a growing LGBT community, and also naturalized U.S. citizens born in places such as Latin America, the Caribbean, Canada, Europe, Asia, and Israel.

Past Broward Problems: this is where they publically admited they are not smart enough to fill out a ballot in 2000. This is where most of the mystery surrounding the death of Ana Nicol Smith were associated. This is where the famous Pachno crime movie "Scarface" was filmed to document the way crime and corruption politics too often join. Since 1976 they organized and developed something called the Broward County Crime Commission was chartered in 1976 as a non-profit, non-partisan, non-political, tax-exempt fact finding body. It acts in behalf of law-abiding citizens generally and the community at large in the fight against crime and corruption. In this effort it supports the major elements of the criminal justice system. It does not sit in judgment of community morals, act as vigilante group, have any authority other than the weight of public opinion, nor have any extra-legal rights. It endorses ethical and moral considerations under the law and demands similar commitment from its members.

Murdering a pregnant woman and cutting her baby from her womb. Is there any crime more shocking or more instinctively against our human nature?

Yet it is happening again and again throughout the country. Beginning with the highly publicized murder of Bobbi Jo Stinnett, we seem to be hearing more and more about crimes like this recently.

Now, Darlene Haynes, a 23-year-old pregnant woman, has been found dead in her apartment in Worcester, Massachusetts. Her 8-month-old fetus was cut from her womb and is currently missing.

Police officers found Darlene Haynes dead after her neighbors complained about a foul smell coming from her apartment yesterday.

Someone had killed her and put her in a closet in her apartment, wrapped in bed sheets. She had been dead for several days when police arrived. Since she was last seen on Thursday by friends, she may have been dead for as many as five days before anyone knew something was wrong.

During the autopsy, police realized that Haynes had been pregnant and that the fetus had been removed from her body.

Authorities believe that Haynes was murdered for her baby and that the murderer currently is in possession of the baby. The baby, if healthy, could survive for several days without medical attention, so it may still be alive.

This is a crime so horrible that I won’t even try to understand it. With so many babies who need homes in this world, a crime like this just doesn’t make any sense. I usually shrug off people who say the end of the world is near, but stories like this make me wonder.

Prof Gates Rights Two Issues

Second angry little guy who thinks everyone is picking on him Gates responded: "Yes, look how tumultuous I am. I'm 5'7, I weigh 150 pounds. And my tumultuous, outrageous action, was to demand that he give me his name and his badge number."

Gates' attorney, Charles Ogletree, told ABC News that his client was "relieved and excited" by the president's telephone outreach.

"It's going to bring together not only the parties to this particular episode but a larger community dialogue about how citizens and police can have more productive and effective exchanges," Ogletree said.

Cambridge Police Responding

Defense: The police officer said he was just doing his job but that Gates continued to rant "that I was doing this because he was a black man in America, that I was a racist."

Representatives of Sgt. James Crowley released a statement saying Crowley was "profoundly grateful" for the phone call.

"It is clear to us from this conversation that the president respects police officers and the often difficult and dangerous situations we face on a daily basis. We appreciate his sincere interest and willingness to reconsider his remarks about the Cambridge Police Department," the statement read.

Earlier today in an unannounced trip to the White House press room, the president clarified remarks he made at the end of Wednesday night's press conference, reiterating his point that "there was an overreaction in pulling Professor Gates out of his home."

Q: who is initiating common sense?

A: The president's spokesman said it was Crowley's idea for the three to get together for a beer. According to Gates' attorney, Gates doesn't drink beer but he'll show-up for the meeting.

A: Patrolman Carlos Figueroa told The Associated Press that when Crowley asked Gates to present identification, the professor shouted, "No, I will not!" Figueroa said Gates called Crowley a racist and shouted, "This is what happens to black men in America!"

A: Bill Cosby weighed in on the debate, telling Boston's WZLX yesterday that he was "shocked" to hear the president's statement.

Obama said it was unfortunate that his comments, instead of illuminating, contributed to "media frenzy" and said he hopes this would be "a teachable moment."

"Because this has been ratcheting up -- and I obviously helped to contribute ratcheting it up -- I want to make clear that in my choice of words, I think, I unfortunately... gave an impression that I was maligning the Cambridge police department or Sgt. Crowley specifically," the president said. "And I could've calibrated those words differently. And I told this to Sgt. Crowley."

"I continue to believe, based on what I have heard, that there was an overreaction in pulling Professor Gates out of his home to the station," the president added. "I also continue to believe, based on what I heard, that Professor Gates probably overreacted as well. My sense is you've got two good people in a circumstance in which neither of them were able to resolve the incident in the way that it should have been resolved and the way they would have liked it to be resolved."

He also defended his decision to make remarks about the incident, saying, "The fact that this has become such a big issue I think is indicative of the fact that... race is still a troubling aspect of our society. Whether I were black or white, I think that me commenting on this and hopefully contributing to constructive, as opposed to negative, understandings about the issue is part of my portfolio."

Lawsuit On The Way?

Alan McDonald, who represents Crowley, the veteran cop who teaches a racial profiling class for rookie police officers told ABC News earlier that the sergeant had not ruled out filing a defamation of character or libel lawsuit against Gates.

"He is exploring all of his options,'' McDonald told ABC News.

Though charges were dropped, Gates has loudly asserted his arrest was a result of racial profiling.

The arrest and subsequent storm of racially charged comments has enveloped the White House after Obama said on Wednesday the Cambridge police acted "stupidly" in arresting the prominent black scholar.

In a press conference held by the Cambridge police unions and Massachusetts Municipal Police Officers Association to support Crowley, members said they hope Obama and Massachusetts Gov. Patrick Deval will apologize for their remarks. Crowley stood with them but remained silent.

McDonald argued that race "played no role in the decision making in this case," adding that it was "inappropriate" of Obama to use this case to talk about racial profiling.

When making his remarks, the president acknowledged that he had not seen all the facts in the case and what role race may have played.

While there is a history of complaints by minorities against officers at the Cambridge Police Department, experts say it's not out of the ordinary compared to other U.S. cities.

"The issues confronting Cambridge are not different from [those] in any other department," Margaret Burnham, a Northeastern University law professor who has sued the department twice, told ABC News. "These things [like the Gates case] happen across the country."

FRANTIC Uri Geller found Michael Jackson so sedated on a trip to the UK he SCREAMED at him to wake up, The Sun can reveal.
Spoonbender Geller battled to rouse his pal after the superstar's aides fixed up a private visit to London Zoo - which had to be scrapped because he was so out of it.
Geller, 62, last night said of the hotel scare: "I was so worried about him. The trouble is nobody said 'no' to Michael and that was a big problem."
Fighting back his grief over the King of Pop's death, Geller revealed for the first time how he often found himself yelling at the singer over his addiction to prescription drugs.
Distraught

He said: "I told him - shouting and screaming - that he would die if things continued as they were."
His chilling revelations came as Jacko's Brit bodyguard also lifted the lid on the star's hell, exclusively telling The Sun how the singer:
FEARED the gruelling run of dates looming at London's O2 arena would be too much - telling him barely a week before he died: "I don't know how I'm going to do 50 shows."
VOWED in another phone call to quit the music business before it killed him - declaring: "I will not end up like Elvis."
PANICKED his entourage who had to beg him to eat - while he let "parasite" doctors pump him full of drugs.
HID the fact a woman nobody knew about was his secret long-term GIRLFRIEND.
Matt Fiddes - Jacko's former head of security and one of his most trusted aides - said of the mystery lover: "She wasn't a celebrity figure - absolutely not." He added sadly: "I imagine she is distraught right now."
Leeches

Martial arts expert Matt, 30, of Barnstaple, Devon, became one of Jacko's closest friends after meeting him thanks to Geller in 1998.
But he watched in horror as the singer hired a succession of private physicians.
Matt branded them "leeches" who had no qualms about dosing their troubled patient with sedatives to relax him - or "uppers" to lift his mood.
The cocktail of drugs left Jacko so weak he regularly slept for DAYS at a time and missed important business meetings. Disgusted Matt said:
The doctors would change every few months - but there was always one there who would often claim just to be a friend.

It went two ways with what they did with Michael. Either he'd be totally sedated or they'd give him something which would make him incredibly high.
When that happened he would chant or be very overexcitable. He had clearly been given some kind of amphetamine-based prescription medication. That concerned the heck out of me.
If you give someone a sedative and then they take an upper, your heart doesn't know where to go. But none of his aides questioned it. If you did that you were thrown out from the court of "yes" men surrounding him.

Recalling Jacko's 2003 trip to London, Matt said: "We had a suite at a top hotel.
"His doctor was there and in the evening he would make me double lock my hotel room door, which was right next to where Michael was.
"He would come in and clearly make sure I was out of the way while he was in the room with Michael.
"Then I would go and check on him again. He would be drowsy and out of it.
"He would manage to walk to his bedroom and fall asleep on the bed - but then he would not wake up until two or three in the afternoon."

The minder said packages full of prescription drugs would arrive at Jacko's hotel from the US marked for "Mr Sterling".
Other aliases included "Jack London" and "Omar Arnold".
He and Geller would routinely sweep the singer's room of syringes and needles - to try to protect him from his own medics.
Matt said of the London Zoo trip that aides booked for the animal-loving star:
Michael had been sedated the night before and just wouldn't wake up. Uri went into his room - and was screaming at Michael.

We were worried. We were shaking him, saying: "Come on - wake up." Uri was saying: "What are you doing? Have you taken something?" Then he came round drowsy - and said he was jetlagged. He came round, but not enough to take him to the zoo. Uri had to make up an excuse for him.

Dad-of-five Matt said lonely Jacko would spend hours holed up in hotel rooms watching his DVD collection of The Simpsons - in which he famously provided the voice for a character in one episode.
The singer would also listen over and over again to Britney Spears. Meanwhile he would barely eat.
Matt said: "He was totally and utterly isolated and he lived on scraps. He'd only eat a quarter of a normal meal.
"He had a small frame but getting him to eat was a big deal - one meal a day and you were lucky. Me and his friends used to literally sit him down and say, 'You eat that'."
Sexuality
He also told how Jacko phoned him to say: "I will not end up like Elvis. I'm going to work hard for a few years, retire, live good and spend the time with my children. I don't want to perform into old age."
In their last phone conversation - less than a fortnight ago - Jacko said of his dates at the O2: "I went to bed praying that I'd sold out ten shows and I was so happy.
"Then I woke up and I saw I'd sold out another 40. I don't know how I'm going to do 50 shows. But I'll find a way."

Matt refused to name Jacko's girlfriend - but said if the singer had been more open about his private life it could have put paid to rumours about his sexuality.
The minder said: "He had his own way of dealing with that - and that unfortunately gave people the wrong impression."
He said of the drugs Jacko was continually prescribed: "Doctors have blood on their hands, and I hope police bring them to justice.

"I've been close to Michael's brother Jermaine for years. We tried everything to get Michael away from these leeches and we just couldn't do it."
Geller said: "I didn't live with Michael, but like Matt, the things I did witness were simply horrifying - and destroyed my hope for his future."

Federal Drug Agents Asked to Join Michael Jackson Death Probe

Federal drug agents have been asked to join the investigation into Michael Jackson's death, ABC News has learned. Until now, the probe into the pop star's death has been managed by the LAPD alone.

The Drug Enforcement Administration's diversion division, which looks into issues of doctor shopping, over shopping, and pill mills, and has regulatory authority over prescription drugs, is now involved with the investigation, two separate sources tell ABC News. Further details are expected to emerge.

The DEA issued an official statement on the investigation that shed little light onto any role they might play in assisting the LAPD.

"We routinely offer assistance to any agency regarding the Federal Controlled Substance act, however at this time we have nothing further to comment about the death of Michael Jackson," the statement said.

A number of prescriptions were found in the Jackson residence, ABC News has learned, that are part of the LAPD probe.

WASHINGTON (AP) - The Supreme Court has ruled narrowly in a challenge to the landmark Voting Rights Act, exempting a small Texas governing authority from a key provision of the civil rights law.

The court, with only one justice in partial dissent, avoided the major constitutional questions raised in the case over the federal government's most powerful tool to prevent discriminatory voting changes since the mid-1960s.

The law requires all or parts of 16 states, mainly in the South, with a history of discrimination in voting to get approval in advance of making changes in the way elections are conducted.

The court said Monday that the Northwest Austin Municipal Utility District No. 1 in Austin, Texas, can opt out of the advance approval requirement, reversing a lower federal court that found it could not.

Construing the amended §2 in Gingles, supra, at 50–51, the Court identified three “necessary preconditions” for aclaim that the use of multimember districts constituted actionable vote dilution. It later held that those requirements apply equally in §2 cases involving single-member districts. Growe v. Emison, 507

U. S. 25, 40–41. Only when a party has established the requirementsdoes a court proceed to analyze whether a §2 violation has occurredbased on the totality of the circumstances. See, e.g., Johnson v. De Grandy, 512 U. S. 997, 1013. Pp. 5–7.

2. Only when a geographically compact group of minority voterscould form a majority in a single-member district has the first Gingles requirement been met. Pp. 7–21.

(a) A party asserting §2 liability must show by a preponderanceof the evidence that the minority population in the potential electiondistrict is greater than 50 percent. The Court has held both that §2 can require the creation of a “majority-minority” district, in which a minority group composes a numerical, working majority of the voting-age population, see, e.g., Voinovich v. Quilter, 507 U. S. 146, 154–155, and that §2 does not require the creation of an “influence” district, in

which a minority group can influence the outcome of an election even if its preferred candidate cannot be elected, see League of United Latin American Citizens v. Perry, 548 U. S. 399, ___ (LULAC). This case involves an intermediate, “crossover” district, in which the mi-nority makes up less than a majority of the voting-age population,but is large enough to elect the candidate of its choice with help from majority voters who cross over to support the minority’s preferred candidate.

Petitioners’ theory that such districts satisfy the first Gingles requirement is contrary to §2, which requires a showing thatminorities “have less opportunity than other members of the elector-ate to . . . elect representatives of their choice,” 42 U. S. C. §1973(b).

Because they form only 39 percent of District 18’s voting-age popula-tion, African-Americans standing alone have no better or worse op-portunity to elect a candidate than any other group with the samerelative voting strength. Recognizing a §2 claim where minority vot-ers cannot elect their candidate of choice based on their own votes and without assistance from others would grant special protection totheir right to form political coalitions that is not authorized by the section. Nor does the reasoning of this Court’s cases support peti-tioners’ claims.

In Voinovich, for example, the Court stated that the first Gingles requirement “would have to be modified or eliminated” to allow crossover-district claims. 507 U. S., at 158. Indeed, manda-tory recognition of such claims would create serious tension with the third Gingles requirement, that the majority votes as a bloc to defeat minority-preferred candidates, see 478 U. S., at 50–51, and would callinto question the entire Gingles framework.

On the other hand, the Court finds support for the clear line drawn by the majority-minorityrequirement in the need for workable standards and sound judicialand legislative administration. By contrast, if §2 required crossover districts, determining whether a §2 claim would lie would require courts to make complex political predictions and tie them to race-based assumptions.

Heightening these concerns is the fact that be-cause §2 applies nationwide to every jurisdiction required to drawelection-district lines under state or local law, crossover-district claims would require courts to make predictive political judgmentsnot only about familiar, two-party contests in large districts but also about regional and local elections.

Unlike any of the standards pro-posed to allow crossover claims, the majority-minority rule relies on an objective, numerical test: Do minorities make up more than 50percent of the voting-age population in the relevant geographic area?

Given §2’s text, the Court’s cases interpreting that provision, and the many difficulties in assessing §2 claims without the restraint andguidance provided by the majority-minority rule, all of the federalcourts of appeals that have interpreted the first Gingles factor have required a majority-minority standard. The Court declines to departfrom that uniform interpretation, which has stood for more than 20 years. Because this case does not involve allegations of intentional and wrongful conduct, the Court need not consider whether inten-tional discrimination affects the Gingles analysis. Pp. 7–15.

(b)

Arguing for a less restrictive interpretation, petitioners point to §2’s guarantee that political processes be “equally open to partici-pation” to protect minority voters’ “opportunity . . . to elect represen-tatives of their choice,” 42 U. S. C. §1973(b), and assert that such“opportunit[ies]” occur in crossover districts and require protection.But petitioners emphasize the word “opportunity” at the expense ofthe word “equally.”

The statute does not protect any possible oppor-tunity through which minority voters could work with other constitu-encies to elect their candidate of choice. Section 2 does not guarantee minority voters an electoral advantage. Minority groups in crossoverdistricts have the same opportunity to elect their candidate as anyother political group with the same relative voting strength. The ma-jority-minority rule, furthermore, is not at odds with §2’s totality-of-the-circumstances test. See, e.g., Growe, supra, at 40. Any doubt asto whether §2 calls for this rule is resolved by applying the canon of constitutional avoidance to steer clear of serious constitutional con-cerns under the Equal Protection Clause. See Clark v. Martinez, 543

U.S. 371, 381–382. Such concerns would be raised if §2 were inter-preted to require crossover districts throughout the Nation, thereby “unnecessarily infus[ing] race into virtually every redistricting.” LULAC, supra, at 446. Pp. 16–18.

(c)

This holding does not consider the permissibility of crossover districts as a matter of legislative choice or discretion. Section 2 al-lows States to choose their own method of complying with the VotingRights Act, which may include drawing crossover districts. See Geor-gia v. Ashcroft, 539 U. S. 461, 480–482. Moreover, the holding shouldnot be interpreted to entrench majority-minority districts by statu-tory command, for that, too, could pose constitutional concerns. See, e.g., Miller v. Johnson, 515 U. S. 900. Such districts are only re-quired if all three Gingles factors are met and if §2 applies based onthe totality of the circumstances. A claim similar to petitioners’ as-sertion that the majority-minority rule is inconsistent with §5 was re-jected in LULAC, supra, at ___. Pp. 19–21.

S. 874, 891, 893 (opinion concurring in judg-ment), that the text of §2 of the Voting Rights Act of 1965 does notauthorize any vote dilution claim, regardless of the size of the minor-ity population in a given district. I join JUSTICE SOUTER’s powerfully persuasive dissent-ing opinion, and would make concrete what is implicit in his exposition. The plurality’s interpretation of §2 of theVoting Rights Act of 1965 is difficult to fathom and se-verely undermines the statute’s estimable aim. Today’sdecision returns the ball to Congress’ court. The Legisla-ture has just cause to clarify beyond debate the appropri-ate reading of §2.

When the California legislature passed amendments to its statute of limitations on child sex abuse in 2002, no one knew that its members were initiating a revolution for child sex abuse survivors.

In California, over 1,000 survivors came forward (about 850 from the Catholic Church). No one knew, though, what the benefits or costs of the window would be. It was a large experiment. Now that the claims have been litigated or settled, however, there are important facts that we have learned for the first time, or that reinforced facts unearthed by previous studies:

First: In California, the names of over 300 perpetrators who had never before been named publicly were released. And the bishops' role in placing children's needs below public appearances was also elaborated. Making that information public is a benefit to every parent and child.

Second, many survivors need decades to come forward. The fact that over 1,000 survivors (from a variety of groups) took advantage of the window confirms what social science studies have shown repeatedly: It is a psychological fact that child sex abuse victims are disabled from revealing the abuse at the time they suffer it and for many years thereafter. However, if given an opportunity to come forward years later, they do want to – and are finally able to – do so.

Third, until the window was in place, society had been making public policy based on too little information. The window revealed that the laws we have focused upon, like sex offender registries and pedophile-free zones, have assumed we know who the predators are. One of the greatest shocks in the last ten years is to learn that we only know about 10% of the perpetrators because of a broken legal system that shuts victims out of court before they get there. (Victims usually cannot name their perpetrators without the legal system, because perpetrators can and will sue the victim for defamation.

After the California statute of limitations (SOL) window closed at the end of 2003, Delaware opened a two-year window in 2007, which will close in July 2009. Once again, in Delaware, survivors deeply appreciated the opportunity for justice and the public was educated about previously anonymous child abusers.

When the California window legislation passed, the hierarchy of the Catholic Church was still reeling from its recent exposure in Boston, and other communities across the country, and did not put up much of a fight. When the hierarchy realized after its passage, though, that many of their victims in California would open the window on the Church's secrets, they quickly mobilized, hiring an army of lawyers in California to fight every case (and now to fight the release of every document,
as I discussed in a previous column

The reform movement has become more sophisticated, with the Survivors for Justice purchasing radio spots urging passage, other groups even hiring lobbyists, and the creation of a comprehensive website, on which I have taken the lead. Moreover, the movement has expanded well beyond survivor groups alone, to now include Parents for Megan's Law, the National Organization for Women, Pandora's Project, Justice for Children, the Leadership Council, and the National Sexual Violence Resource Center, among many other worthy organizations.

It's not unusual to hear news stories about individuals who have languished in prison for years to be freed based on exonerating DNA evidence. The value of evidence from DNA tests for law enforcement and the prosecution in pursuing and establishing the guilt of a defendant is tough to dispute. In a close 5-4 Dist. Atty's Office for the Third Jud. Dist v. Osborne decision today, the Supreme Court today announced that there is no constitutional right for someone who has been convicted of an offense to get access to the prosecution's evidence to perform DNA testing.

In the eyes of the Court's majority the issue may have boiled down to one of procedure after someone has been convicted. With the consideration that someone has already been found guilty, the issue is best left to the legislatures of the states to resolve. Indeed, the Court pointed out that 46 states and the federal government already have laws dealing specifically with access to DNA evidence.

It was inevitable I suppose. After just six months in office the Light Fantastic, Barack Obama, was actually booed during a speech - by Doctors! Read more below, see photos and the video.

Frankly, I didn’t know they had it in them! If the reception Barack Obama got from doctors at the American Medical Association meeting is an indicator, The One is in for a bumpy ride as he tries to sell ‘Obamacare’ - his plan to socialize our country’s health care system.

Those rowdy doctors booed Obama when he told them he wouldn’t help them win their top legislative priority: placing limits on jury damages in medical malpractice cases.

Of course we know what would have happened if The One had said he would help the doctors — the trial lawyers and unions who are major supporters of Democratic candidates would go ballistic. And that would be just the beginning. A wide variety of consumer groups would also revolt against Obama and we can’t have that now can we?

The doctors at the AMA meeting are only the first stop on Obama’s effort to socialize our health care in this country. Of course, his efforts to stamp out private insurance and subplant it with ‘Obamacare‘ would reduce the best medical care in the world to a mere shadow of itself — bad news for American taxpayers, health-care providers, and, most important, patients.

It is certainly clear, after just six months in office, that Barack Obama’s vision for our country is one where the government is greatly involved in the private sector: sometimes mandating heavily, sometimes taking over, sometimes competing. And despite Obama being booed by doctors, his efforts to get Obamacare passed by the end of his first year in office is a priority.

Q: Why all the stress among our national physicians?
A: Until this administration everyone encouraged them to be loyal to their historic Hypocratic Oath.

The Hippocratic Oath is an oath traditionally taken by physicians pertaining to the ethical practice of medicine. It is widely believed that the oath was written by Hippocrates, the father of western medicine, in the 4th century BC, or by one of his students.

It is thus usually included in the Hippocratic Corpus. Classical scholar Ludwig Edelstein proposed that the oath was written by Pythagoreans, a theory that has been questioned due to the lack of evidence for a school of Pythagorean medicine.

The phrase "Above all, do no harm" is usually attributed to the oath. Although mostly of historical and traditional value, the oath is considered a rite of passage for practitioners of medicine, although it is not obligatory and no longer taken up by all physicians.

apparently, The One is practicing hardball politics, chicago-style, with the firing of the inspector general, gerald walpin for his aggressive investigation of the misuse of federal americorps funds by sacramento, california mayor, former nba star, and big time obama supporter, kevin johnson as well as the research foundation of the city university of new york. you can read inspector walpin’s very lucid reports here.

Walpin told POLITICO. “There’s nothing confusing about malfeasance and there’s nothing confusing about what appears to be the fact that they terminated me because I was doing my job because the White House wanted to protect people who proclaim they are friends of the White House.”

Obama has in effect, cleared the way to install his lackeys who will protect the government volunteerism industry and its democrat cronies. and a cold chill has undoubtedly taken hold in every other inspector general’s office in washington.

Kan. man convicted of Craigslist rape found dead

WICHITA, Kan. (AP) - A man facing nearly 30 years in prison for raping three women who had advertised in the "erotic services" section of Craigslist apparently committed suicide in his Kansas jail cell.

The Sedgwick County Sheriff's Office says David Lee Gage of Wichita was found dead around 6:10 a.m. Monday at the county jail.

The 52-year-old from Wichita had been in custody since August 2008. He was awaiting transfer to prison after being convicted in May of seven felony counts, including three counts of rape.

Prosecutors say Gage met the women at motels, then flashed a federal marshal's badge and threatened to arrest them for prostitution if they didn't have sex with him.

The sheriff's office says it's the first suicide in that jail since 2006.

Deputy Tasers woman, 72, during traffic stop

AUSTIN, Texas (AP) - Cursing and belligerent, the great-grandmother refused to sign her speeding ticket, got out of her truck and dared a deputy to shock her with a Taser.

So he did. Video released by a Travis County Constable's Office shows 72-year-old Kathryn Winkfein hitting the ground and moaning while the shocks jolted through her body after the May 11 confrontation with Travis County Sheriff's Deputy Chris Bieze.

Winkfein was stopped for driving 60 mph in a 45-mph zone just west of Austin. A dashboard camera in the deputy's car shows the 4-foot-11 Winkfein refusing to sign her speeding ticket, getting out of her white pickup truck and cursing at the deputy constable.

Bieze then pushes her to get her away from traffic. "You're gonna shove a 72-year-old woman," Winkfein says angrily, standing inches from the deputy.

"If you don't step back, you're going to get Tased," Bieze says. "Go ahead, Tase me," Winkfein says. "I dare you." The video shows Bieze using the Taser and Winkfein hitting the ground and moaning in pain. "Put your hands behind your back or you're going to be Tased again," Bieze yells, and then hits her with another jolt.

Winkfein was eventually charged with resisting arrest, a misdemeanor punishable by up to a year in jail and fines up to $4,000. A telephone message left with Constable Sgt. Maj. Gary Griffin of the constable's office was not immediately returned Wednesday. Telephone calls to a number listed for Kathryn Winkfein in Marble Falls, about 50 miles west of Austin, went unanswered.

Griffin has defended Bieze's actions and that Winkfein was belligerent and difficult to handle.

But Travis County Sheriff Greg Hamilton, whose office does not oversee the constables, issued a statement Wednesday saying: "I do not personally agree with the actions of the deputy constable as they are shown in the video. When I look at the video I am in awe of what happened."

The Taser fires two small dart-like electrodes, which stay connected to the main unit by conductive wire as they are propelled by small compressed nitrogen charges. Taser devices are not considered firearms by the U.S. government. Amnesty International has documented over 245 deaths that occurred after the use of Tasers. Texas documents more than 180 deaths as of 2006. Despite the growing controversy, a study funded by the U.S. Justice Department asserted that majority of people tasered from July 2005 to June 2007 suffered no injury. A study led by William Bozeman, of theWake Forest University Baptist Medical Center, of nearly 1,000 persons subjected to Taser use, concluded that 99.7% of the subjects had either minor injuries, such as scrapes and bruises, or none at all, while three persons suffered injuries severe enough to need hospital admission, and two other subjects died. Police officers that patrol schools, including grade schools, in several U.S. states (including Kansas, Minnesota, Kentucky, Virginia and Florida), currently carry Tasers. In 2004, the parents of a 6-year-old boy in Miami sued the police department for tasering their child. The police said the boy was threatening to injure his own leg with a shard of glass, and claimed that using the Taser was the only option to stop the boy from injuring himself. Note: as we move further and furthe away from our roots with a high view of thinking citizens it suddenly becomes normal to take up using a tazer as a torture device at a time when spanking is still illegal.

Tazer Torure Issue: A report from a meeting of the United Nations Committee against Torture states that "The Committee was worried that the use of TaserX26 weapons, provoking extreme pain, constituted a form of torture, and that in certain cases it could also cause death, as shown by several reliable studies and by certain cases that had happened after practical use.

Amnesty International has reported several alleged cases of excessive electroshock gun use, that possibly amount to torture, including the death of an individual after being struck 12 times with a Taser in Orange County, Florida. They have also raised extensive concerns about the use of other electro-shock devices by American police and in American prisons, as they can be (and according to Amnesty International, sometimes are) used to inflict cruel pain on individuals. For example, Eric Hammock of Texas died in April 2005 after receiving more than 20 Taser shocks by Fort Worth police officers. Maurice Cunningham of South Carolina, while an inmate at the Lancaster County Detention Center, was subjected to continuous shock for 2 minutes 49 seconds, which a medical examiner said caused cardiac arrhythmia and his subsequent death. As part of his show he Joked that her fourteen-year-old daughter being raped byNew York Yankees star Alex Rodriguez.

The late-night host had drawn particular fire from Palin and some pundits for a joke about one of Palin's daughters being impregnated by New York Yankees star Alex Rodriguez during a trip to Yankee Stadium.

Letterman's Liberal Defense: “We were, as we often do, making jokes about people in the news and we made some jokes about Sarah Palin and her daughter [Bristol]... and now they’re upset with me…” Letterman says on tonight's show. "These are not jokes made about her 14-year-old daughter. I would never, never make jokes about raping or having sex of any description with a 14-year-old girl.... Am I guilty of poor taste? Yes. Did I suggest that it was okay for her 14-year-old daughter to be having promiscuous sex? No." Saying he hopes he's "cleared part of this up," Letterman extended an invitation to Palin to come on the show as a guest.

Miss California Fired Again Second Time

LOS ANGELES (Reuters) - Beauty queen Carrie Prejean, who ignited a furor at the Miss USA pageant by taking a stand against gay marriage, has been fired as Miss California for violating her contract, officials said on Wednesday. Prejean, who nearly lost her Miss California crown last month following the same-sex marriage flap and revelations that she had posed topless at age 17, failed to fulfill her duties, a pageant spokesman said.

According to a top Republican on the House Intelligence Committee, President Obama and his administration have ordered FBI agents to read terror suspects their Miranda rights; even though they have been captured on foreign soil and are not U.S. citizens officially protected by the Miranda vs. Arizona decision over 40 years ago.

Michigan congressman Mike Rogers, met recently with military, intelligence, and law-enforcement officials on a fact finding trip to Afghanistan. What he found was deeply troubling. The Obama Justice Department has quietly ordered the FBI to issue Miranda rights to foreign fighters captured on the field of battle.

“ We the People of the United States, in Order to form a more perfect Union, establish Justice, ensure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

Bill of Rights: The United States Bill of Rights consists of the ten amendments added to the Constitution in 1791, as supporters of the constitution had promised critics during the debates of 1788. The English Bill of Rights (1689) was an inspiration for the American Bill of Rights. For example, both require jury trials, contain a right to keep and bear arms, and prohibit excessive bail as well as "cruel and unusual punishments." Many liberties protected by state constitutions and the Virginia Declaration of Rights were incorporated into the United States Bill of Rights.

1. First Amendment: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

2. Second Amendment: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

3. Third Amendment: No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

4. Fourth Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

5. Fifth Amendment: No person shall be held to answer for any capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

6. Sixth Amendment: In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district where in the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.

7. Seventh Amendment: In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any court of the United States, than according to the rules of the common law.

8. Eighth Amendment: Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

9. Ninth Amendment: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

10. Tenth Amendment: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Source of the Bill of Rights: To some degree, the Bill of Rights (and the American Revolution) incorporated the ideas of John Locke, who argued in his 1689 work Two Treatises of Government that civil society was created for the protection of property (Latin proprius, or that which is one's own, meaning "life, liberty, and estate"). Locke also advanced the notion that each individual is free and equal in the state of nature. Locke expounded on the idea of natural rights that are inherent to all individuals, a concept Madison mentioned in his speech presenting the Bill of Rights to the 1st Congress. 7th Amendment “Common Law”

Seventh Ammendment refers to a safe body of what the author called Common Law: This safe body of common law was meant to protect all of our Bill of Rights including the 4th amendment right of the people to be secure in their persons, houses, papers, and effects. Historically [until the counter culture revolution] this body of common law did a pretty good job of informing courts at all levels as well as state and local governments about our rights each citizen is to enjoy. We were free to speak, own firearms, go to any church of our choice who did not pay taxes, supported our church with deductions from our taxes. We were free to own and protect our properties or real estate and the government helped protect us with local police forces who worked for the people. That protection however was limited by misapplication of the 5th amendment which in fact gave super citizenship rights to criminals. Police and armed forces themselves enjoyed historical protection from injury when they faithfully did their duty but this again has been set aside to favor the super rights of our criminal neighbor by misapplication of the 5th amendment.

Common Law: is law created and refined by judges: a decision in a currently pending legal case depends on decisions in previous cases and affects the law to be applied in future cases. When there is no authoritative statement of the law, judges have the authority and duty to make law by creating precedent. The body of precedent is called "common law" and it binds future decisions. In future cases, when parties disagree on what the law is, an idealized common law court looks to past precedential decisions of relevant courts. If a similar dispute has been resolved in the past, the court is bound to follow the reasoning used in the prior decision (this principle is known as stare decisis). If, however, the court finds that the current dispute is fundamentally distinct from all previous cases, it will decide as a "matter of first impression."
